have you tried just building one through JAXB?
see javadoc for DocumentBuilder:

http://java.sun.com/j2se/1.4.2/docs/api/javax/xml/parsers/DocumentBuilder.html#newDocument()

(haven't tried it, but I see no reason why it wouldn't just work)
