I agree and this discussion is very useful. I understand what you mean and I agree. The kind
of shape I have in mind is different to what GeoDegeneratePoint is.

The only solution I find is the following: 

Change line 114 of GeoBaseAreaShape to:

if (!(geoShape instanceof GeoPoint) && intersects(geoShape)){ 
      return  GeoArea.OVERLAPS;
}

That would do as GeoPoint do not OVERLAP.
