I can't immediately think of a good workaround.  XmlBeans v2 will have
live DOM support, but it's not quite ready yet.  If you have a small set
of known paths to execute, you could simply use XmlCursor to search the
document instead of XPath.  Or you could use a combination of pathing
and cursor.
